Privacy Policy

Privacy Policy (art. 13 D.Lgs 196/2003)

To use and to register on the Website, the User must read the Privacy Policy for the processing of personal data and must give his/her free consent to the processing of his/her personal data, by selecting the relevant checkboxes.

MakeTank S.r.l., VAT number and fiscal code 06265500485, registration number in the Register of Companies of Florence 614098, with its head office in Via della Torretta, 16 in Florence (hereinafter “MT”), is the Controller of your personal data.
With this document the Data Controller provides the information required by law (The Legislative Decree of 30 June 2003, n.196 "Code regarding to protection of personal data". hereinafter "Privacy Code").
The Privacy Code sets out the rules for the processing of personal data and provides that such processing shall follow the principles of fairness, legality, transparency confidentiality as well as the protection of the rights of the data subjects.

Personal data that may be collected
This Website may collect 5 (five) different categories of personal data:
1) Navigation data, and in particular the IP address from which the User is connected. Retention of IP address records is mandatory;
2) The User’s personal data provided by the User provided by the User upon registration (e.g. name, surname, birthday, gender, address, etc.), newsletter subscription (e.g. name, surname, e-mail), while performing activities on the Website such as transactional data (credit card number, current account, etc.), shipping data (city, address, etc.) billing data, as well as the data provided in community discussions, comments (on blogs, social media, etc.), support requests, correspondence, and any additional data provided necessary to provide the service.;
3) The personal data of the User or of third parties provided by third parties, for example, when the User accesses the Website through other websites which transfer information.
4) The personal data of third parties provided by the User, for example, when a User uploads third parties’ data (e.g. third parties’ picture, name or email address) or requests to ship a Product to a third party. If the User provides, directly or through third parties, personal data of a third party, the User must inform the party to whom those data refer about the Privacy Policy and get his/her consent to data processing..

Purpose of processing
The navigation data are processed to provide the requested services and assistance, to fulfil the obligations required by law and to protect the rights of MT;
All the other personal data are processed to provide the requested services and assistance, including promotions and updates, to fulfil the obligations required by law and to protect the rights of MT.
Moreover, subject to the consent of the User (i.e. the physical person to which the personal data relate), such data may be used or communicated to third parties:
a) For commercial purposes;
b) To conduct studies;
c) For Statistical research;
d) For Market research;
e) To display customized advertising or to host sponsorships according to the User's preferences;
f) To promote the Website and its services through blogs, newsletters and trhough any other digital communication tools;
g) To customize and improve the service, the contents and the advertisement in a targeted manner;
h) For other purposes specified from time to time.

Means of processing
Personal data processing can be done manually, electronically or through digital tools, strictly for the purposes herein specified. Data may be associated or integrated with data from other databases
All personal data is processed in compliance with the provisions of the Privacy Code, by adopting minimum safety measures to minimize the risk of destruction or loss, even accidental, of the data, of unauthorized access or of processing inconsistent with the purposes of collection.

Nature of the providing of personal data, consequences of not providing the data
Providing data is optional, except for those marked as mandatory to complete your registration and to access the services.
If the User does not provide mandatory data, MT will not be able to provide the service.
There are no consequences if the User does not provide optional data.
Providing navigation data is automatic and necessary for the correct operation of the Website.

Communication of personal data
All the collected data will be retained by MT (and known by its manager, employees and consultants) and may be communicated by MT to consultants and suppliers (Vendors and couriers included) to provide the services requested by the User (such as subscriptions, registrations, transactions, shipments, customer services, etc.) to ensure the functionality of the Website and to ensure the management of MT.
The data collected may be disclosed to third parties, particularly to public bodies and/or private entities when such disclosure is required by the law or necessary to regulate the relationship; data may be disclosed to public authorities and bodies, as required by law.
Subject to express consent of the data subject, MT may also disclose User’s data to third parties for commercial purposes, to conduct studies, statistic research, market research, and for the other purposes specified herein for which the consent is acquired.
User’s or third partie’s personal data will be disclosed to the public through the Website, according to the choice of the User..
The subjects to whom the data can be communicated, will use the received data as independent data controllers or processors, according to the law, in complete autonomy and unrelated to the processing carried out by MT. They may not use the data for any purpose beyond those agreed upon in the agreement. The list of subjects to whom the data may be disclosed is provided by MT on demand.

At the present time, some of the processors that process your data are:
1) Alias, S.r.l., fiscal number 01648260519, Via Cennano 31-33, Montevarchi (Arezzo), Italy, for the data processing related to the management and maintenance of this Website;
2) Each Vendor, who processes the data required to handle orders, shipment, delivery and return of the products sold on the Website.
3) Each shipping agent, who processes the data required for shipment, delivery and return of the products sold on the Website.
4) Digital Ocean, for the processing of data needed for the data processing related to the call centre and customer service.
5) The Rocket Science Group, LLC d/b/a MailChimp, for the processing of data needed for the data processing related to the call centre and customer service.
The list of other possible data processors or controllers, external and internal, may be requested to MT.

Right to Access Personal Data and Other Rights (art. 7 D.Lgs. n. 196/2003)
The User has the right to request cancellation, communication, updating, rectification, integration of his/her personal data, and, more generally, may exercise all the rights under Section 7 of the Privacy Code as provided below.
“1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of its being already recorded, and communication of such data in an intelligible form.
2. A data subject shall have the right to be informed:
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3. A data subject shall have the right to obtain:
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, rendering anonymous or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4. A data subject shall have the right to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys”.

Data controller and data processor
The data controller is MT, whose details are indicated in the first section of this policy.
The list of other possible processors, external and internal, may be requested to MT.

Collection and processing of personal data in Italy or abroad
By registering on the Website or using it, the Users agree that the data provided will be stored on servers located in Italy or in other countries as specified in this policy, where MT may locate its servers. At the present time, personal data collected by MT are stored in the servers of Digital Ocean, which are located in Digital Ocean web farm AMS2 localized in The Netherlands.
Personal data relating to the newsletter are stored in the servers of Mailchimp, a service provided for by The Rocket Science Group, LLC d/b/a MailChimp, a State of Georgia limited liability company 675 Ponce de Leon Ave NE, Suite 500, Atlanta, GA 30308, USA

Limitation of Liability
This Website contains hyperlinks to web sites in which different privacy policies may apply. MT is not responsible for and has no control over the privacy policies of such external websites; therefore, MT invites its Users to carefully read the privacy policies of those webpages.
MT complies Italian laws on data processing and follows generally accepted industry standard to protect the personal information submitted. However, third parties may unlawfully intercept or access transmissions or private communications, and other Users may abuse or misuse your personal information that they collect from the Website. No method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, MT cannot guarantee, and the User should not expect, that personal information or private communications will always remain private.

Amendments
We may amend this Privacy Policy at any time by posting the amended terms on this Website and notifying the Users through the Website or by e-mail.
All amended terms automatically take effect 15 days after they are initially posted

Consent
According to the applicable law, the User must give his free, specific and informed consent for the processing of data by selecting the box “I accept”. The consent relates to the processing of data for which consent is required by law, and not for processing for which law does not require consent.
